This second bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant Manoj Gupta, seeking enlargement on bail during trial in connection with Case Crime No. 3 of 2017 under Sections 302, 307 I.P.C., registered at P.S. Vijay Nagar, District Ghaziabad. 4. The first bail application of the applicant was rejected by this Court vide order dated 10.08.2023 passed in Crl. Misc. Bail Application No. 34003 of 2023 (Manoj Gupta Vs. State of U.P.). 5. At the very outset, learned counsel for the applicant submits that the trial in the present matter has concluded and as such the bail application has become infructuous and be dismissed as such. 6.
