HON'BLE PRASHANT MISHRA-I, J. 1. Heard Sri Ram Tiwari, learned counsel for the appellant; Sri Sushil Kumar Pandey, learned AGA for the State and perused the trial court record. 2. The above noted criminal appeal has been preferred against the judgement and order of conviction dated 27.4.1985 passed by Session Judge, Fatehpur, in Criminal Sessions Trial No.131 of 1984, convicting and sentencing the appellant for life imprisonment, under Section 302 IPC and five- five years rigorous imprisonment under Sections 364 and 201 IPC. 3. The prosecution case is that on 08.1.1984 at about 9:00 p.m. co-villager of informant, namely, Heera Lal and Mool Chandra, came and called his brother, Moorat Singh and took him alongwith them.
