The Nagar Nigam, Lucknow has given a notice to the petitioner alleging encroachment by them on Nagar Nigam land bearing Khasra No.617, however, the contention of learned counsel for the petitioners is that the petitioners were not aware of the basis on which the said notice has been issued. On being confronted, learned counsel for Nagar Nigam, Shri Rajesh Kumar Singh states that demarcation exercise was undertaken jointly by the officials of the Nagar Nigam and the revenue officials, based on which the notice has been issued, even though the notice does not mention it in so many words nor is the report of such exercise annexed with the notice. 3. We are of the opinion that if any such exercise was to be undertaken, it should have been undertaken in terms of the provi
