After arguing the matter at some length, learned Counsel for the private opposite party, Shri Sameer Singh, on being confronted with the situation where the Tribunal while allowing the claim petition of the opposite party on procedural grounds and principles of natural justice has not granted liberty to the State to proceed afresh, he fairly submitted that this liberty could not have been denied. 4. Although, there is some delay in filing the writ petition, but considering the fact that the private opposite party is represented before us, and the illegality is apparent on the face of record, we exercise our discretion to admit the writ petition and, in fact, allow it on the sole ground, as mentioned hereinabove. 5.
