By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for direction to the respondent to fix pension of the petitioner on the basis of last pay drawn that was Rs. 53600/- with grade pay 4600/- . Submission advanced by learned counsel for the petitioner is that the petitioner was earlier employee of the Auto Tractors Ltd., which services he had joined in the year 1981, however upon abolition of the Company, which was a government company, the petitioner came to be absorbed in Revenue department of the State of U.P. vide Government Order dated 11th November, 1993 as the retrenched employee were directed to be absorbed to the regular establishment of the Government. It is contended that in pursuance thereof services of the petitioner rendered ATL taking into account
