By means of this petition filed under Article 226 of the Constitution petitioner (since deceased) has prayed for interest over and above the delayed payment of arrears of salary for the period running from 01.10.1981 to 29.01.1994, the period under which the petitioner was under suspension. 3. It is contended that after the petitioner was reinstate on 17.04.1994 petitioner claimed salary also for the period he had remained under suspension. It is submitted that the petitioner was placed under suspension on account of criminal case pending against him and upon acquittal being awarded to him in the said criminal case by the learned Magistrate on 27.08.1987, no further appeal was preferred by the State and hence, as a consequence to the same, if the petitioner
