Public Services Tribunal, Lucknow in Claim Petition No. 710 of 2008 by which the claim petition of the respondent herein who was the claimant before the Tribunal, was allowed. The order dated 09.01.2009 by which the claim of the respondent herein was being considered for promotion to the post of Assistant Commissioner, Commercial Tax w.e.f. 17.07.1996 was declined, was quashed by the Tribunal on a finding having been recorded that juniors to him had been promoted and that there is nothing adverse in the career to deny the same to him.
