The orders of punishment, as also, the appellate order were under challenge in the claim petition bearing no. 508 of 2013. The same was dismissed a couple of times for want of prosecution, and ultimately, it was again dismissed for the same reason on 05.08.2021. The Tribunal has held that the claimant was negligent and not diligent in pursuing the proceedings. Only, to prevent, injustice being caused, and to serve the ends of justice, we set aside the impugned order giving last opportunity to the petitioner herein to pursue his claim petition before the Tribunal diligently, especially as, no written statement was filed by the opposite parties. Consequently, the claim petition no. 508 of 2013 shall stand restored to its original number and shall be listed before the Tribunal on 06.10.2025. By then, the written statement shall be filed
