Heard learned counsel for the parties and perused the records. 2. The submission advanced by learned counsel for the petitioner is that petitioner’s father, who was a part-time tube-well operator initially engaged in the year 1990 was subsequently engaged in a prescribed pay- scale vide order dated 1st June, 1999 though he was described as part- time tube-well operator. It is contended that since petitioner’s father was continuously working as a tube-well operator, may be assigned a status of part-time tube-well operator but in a regular pay-scale, he would be taken to have died while serving with the respondent establishment on substantive vacancy. 3. It is contended that this controversy regarding part-time tube-well operator for the purposes of benefit to be given to the dependents of such employees dying in harness under the U.P.
