A very short legal question is involved in this case, as to whether disciplinary authority is justified in directing for re-enquiry into the same charges after accepting the inquiry report submitted by the inquiry officer earlier and issuing a show cause notice to the petitioner-- delinquent employee giving him a copy of the inquiry report, in purported exercise of power under Rule 9 (4) of the U.P. Government Servant (Discipline and Appeal) Rules, 1999. 3.
