By means of this petition filed under Article 226 of the Constitution, petitioner is seeking a writ in the nature of mandamus to command respondent No.- 5 to consider the claim of the petitioner for promotion from the post of constable to head constable. It is contended by learned counsel for the petitioner that petitioner's earlier promotion was withheld only on the ground that petitioner got implicated in the criminal case in which he subsequently obtained bail, however, in the departmental proceedings the order of disciplinary authority has come to be set aside in appeal by the departmental appellate authority allowing the appeal of the petitioner.
