It is admitted to learned counsel for the petitioner that petitioner had earlier approached this Court against the order impugned dated 5th July, 2023 by means of a writ petition being Writ – A No.- 43709 of 2013, which stood dismissed in default on 13th February, 2020. It is contended that since petitioner's earlier counsel has not been cooperating, petitioner could not file a recall application. In my considered view, if petitioner's counsel is not cooperating, petitioner himself can appear in person to file recall application but no second writ petition can be entertained when earlier writ petition is dismissed without any further liberty. In view of the above, I decline to grant indulgence in the matter. The writ petition is consigned to records.
