After some arguments, learned counsel for the petitioner states that he may be permitted to withdraw this petition with liberty to file afresh challenging the order of re-fixation which has resulted in deduction of pay from what he was drawing at the time of retirement and consequential adverse effect of pension. Learned Standing Counsel has no objection to the above request. In view of the above, this petition is dismissed as withdrawn with aforesaid liberty.
