Learned Standing Counsel, on the contrary, submits that petitioner has already preferred a departmental appeal and hence petitioner should get the appeal decided at the first instance. Learned counsel for the petitioner very fairly considers that he has already preferred statutory appeal on 24th May, 2022, which has pending consideration but no decision has been taken till date.
