And 3 Others Counsel for Petitioner :- Kamal Nayan Tripathi Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. 1. Heard learned counsel for the parties. 2. By means of this petition filed under Article 226 of Constitution of India, the petitoner has prayed for a direction in the nature of writ of mandamus to the selecting and appointing authority to grant benefit of the horizontal reservation in the category of freedom fighter. 3. Learned Standing Counsel submits that the petitioner cannot maintain this claim as while submitting the application form pursuant to the advertisement made by the U.P. Police Recruitment and Promotion Board in February, 2021, petitioner had not applied under freedom fighter's category and hence petitioner's claim is baseless and now he cannot set up a claim for horizontal reservation. 4. Upon a pointed query being made, learned counsel for the petitioner could not dispute the above facts. 5. In view of the above, petition is dismissed.
