Heard learned counsel for the petitioner as well as Sri S.K. Pal, Deputy Solicitor General of India appearing for the respondents. Learned counsel for the Union of India has raised a preliminary objection as to the maintainability of this petition on the ground that petitioner while moved an application being posted at Mumbai, the said application for voluntary resignation has come to be accepted by the authority sitting in Orissa, hence he can maintain a petition either before the Court having territorial jurisdiction in respect of State of Orissa or for part of cause of action arising at Mumbai, as he had moved an application while being posted at Mumbai, he may file petition at Bombay High Court. In such circumstances, therefore, this Court has no territorial jurisdiction in respect of the authorities that have passed the order.
