The submission advanced by learned counsel for the petitioner is that the respondents are not justified in instituting disciplinary proceedings against the petitioner taking recourse to Article 351-A in respect of some alleged irregularity and illegality claimed to have been happened in the year 1999 and 2001. It is contended that the petitioner has attained age of superannuation on 31.07.2018. It is further contended that both on the point of initiation of disciplinary proceedings in respect of a matter beyond period of four years of date of superannuation and further initiating the proceeding beyond a period of four years after retirement, the order is absolutely unsustainable. 2. Learned Standing Counsel for the State is to obtain instruction in the matter by the next date fixed. 3. List this case on 13.08.2025 amongst top ten cases."
