By means of this petition filed under Article 226 of the Constitution, petitioner is seeking a writ of mandamus to command the respondent No.- 2, who is the competent authority in the matter, to consider the claim of the petitioner for compassionate appointment on account of his father dying in harness on 13th February, 2025 from the respondent establishment. Learned Standing Counsel submits that there is a rival claim set up by one brother, namely Jitendra Chauhan and hence respondent is to take decision considering the rival claims. Learned counsel for the petitioner has also drawn the attention of this Court towards the order dated 15th May, 2025, whereby the administrative officer of Collectorate Deoria has rejected the objection filed by one Jitendra Chauhan.
