Instructions placed today before the Court by learned Standing Counsel is taken on record. Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has assailed the order of transfer on the ground that he is suffering from medical cardiac problem. Per contra it is submitted by learned Standing Counsel that the petitioner has over stayed at Azamgarh and therefore, he deserves to be transferred under the transfer policy to another station, However, he has no objection, if petitioner makes a fresh representation before the authority concerned namely the respondent no. 2 who is further directed to consider and dispose of the same strictly in accordance with law. In view of the above, this petition stands disposed of with a direction to the petitioner to make a fresh representation before the competent authority
