Counsel for the appellant very fairly submits that this special appeal is not maintainable in view of Full Bench judgment of this Court in the case of Sheet Gupta vs State of U.P. and others, UPLBEC (2010) 1 and the decision of Hon'ble the Supreme Court in State of U.P. vs. Madhav Prasad Sharma, 2011 (2) SCC 212, therefore he does not want to press the appeal, however, with liberty to challenge the impugned judgment before Hon'ble the Supreme Court. 2.
