The appellant was under suspension and on reinstatement, order was passed posting him at Nagar Nigam, Gorakhpur whereafter another order was passed transferring him from Nagar Nigam, Gorakhpur to Nagar Nigam, Varanasi. 3. Feeling aggrieved, the petition was filed. 4. The challenge laid was principally on the ground that order has been passed by an incompetent authority as the same was signed by Under Secretary of the department. 5.
