This recall application has been filed for recall of the order dated 05.12.2016 passed in Special Appeal No. 1002 of 2007, whereby a Coordinate Bench of this Court noticed the fact that Shri Arun Kumar, learned counsel for the appellant, was not ready to argue the appeal and, accordingly, the appeal was dismissed for want of prosecution. 2. The recall application has been filed by the same counsel Mr. Arun Kumar, inter alia, indicating that he was not prepared with the matter for final hearing and that the order dated 05.12.2016 be recalled. 3. The recall application is pending since the year 2016 and when the matter last came up before this Court on 04.08.2025, non appearance of counsel for the appellant was noticed and the urgency pleaded by counsel for the respondent
