The grievance of the petitioners is that the land in question was being used as a 'rasta' but the opposite party no. 6, which is a private society, has made constructions thereon. 4. Shri S.K. Singh, learned C.S.C. refutes the contention of the petitioners on the basis of written instructions to the effect that the land is not recorded as 'public road' or 'rasta', but is recorded as 'bhumidhari' land in the name of opposite party no. 6. 5. Considering the nature of the dispute which has arisen, we are of the opinion that this is not a case for consideration as a Public Interest Litigation under Article 226 of the Constitution of India, as primarily, it appears to be a private dispute.
