Heard learned counsel for the petitioner as well learned Standing Counsel for the State-respondent(s) and perused the material brought on record. 2. The present petition has been filed by the petitioner with the following prayer: "(i) to issue a writ, order or direction in the nature of Mandamus commanding the opposite parties concerned, initiate steps to construct the Khadanja on Chakmarg having land Gata No. 1268, 1275, 1277, 1279 Village Dehli Bazar, Pargana Brausha, Tahsil-Baldirai, District-Sultanpur, within specified time and to protect the common rights of villagers, in the interest of justice." 3. Learned Standing Counsel, based upon instructions, states that out of the five cases instituted, one case is pending for adjudication and in respect of the other four cases, the appeal has been preferred, which has been pending. 4. In v
