If it is so, then there are remedies prescribed for the same under various statutes including provisions of the B.N.S.S., 2023, the Revenue Code if applicable and the Uttar Pradesh Roadside Land Control Act, 1945 etc. which can be availed. Public Interest Litigation need not be entertained in the facts of this case when there are remedies prescribed, especially as it would be a question of fact to be determined as to whether actually the construction alleged is on a Highway or a public road or not.
