Shri Rahul Kumar, learned counsel appearing on behalf of respondent No.5 apprises the Court that in between the parties and the father of the petitioner, a dispute under Section 38 of the U.P. Revenue Code, 2006 is going on. 3. In view of the said dispute going on, clearly the matter cannot be put up and filed as a Public Interest Litigation. The petitioner has misused the forum by filing a PIL, as such, the petition is dismissed with a cost of Rs.1,000/-, which shall be paid to learned counsel for respondent No.5.
