This petition purportedly in public interest has been filed by the petitioner seeking removal of alleged illegal encroachments over Gata No. 772 which is claimed to be reserved for public path. 3. A perusal of pictures produced along with petition (Annexure-4) clearly reflects that the construction is not new and appears to be very old. 4. Filing of Public Interest Litigation for the purpose of seeking demolition of constructions which are existing for a long time, without adverting to the procedure prescribed in law, cannot be countenanced. 5.
