The Additional Commissioner has explained himself in Court and there were some misconceptions in his mind about the position of the law, which appear to be bona fide. Since the Additional Commissioner is a lay officer, he cannot be blamed much for the inaccurate understanding of the position of the law on the basis of which he has passed the order dated 28.01.2025. We are satisfied with the explanation furnished by him, though not about the merits of the order. The exemption application is allowed.
