Goyal (A.C.S.C.) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J. 1. This petition, purportedly under Article 228 of the Constitution of India, has been filed by the petitioners seeking a direction to transfer cases pending at Varanasi to Lucknow. 2. The provisions of Article 228 of the Constitution of India provides for transfer of cases to the High Court, in case the Court is satisfied that the matter pending before the subordinate Court involves substantial questions of law as to the interpretation of the Constitution. 3. In the present case, no such ground has been made out nor a plea has been raised. 4. Filing of the petition under Article 228 of the Constitution of India, in the nature of prayer made, is wholly misconceived. 5. The petition is, therefore, dismissed leaving it open for the petitioners to adopt appropriate means for seeking transfer from Varanasi to Lucknow. Order Date :- 8.8.20
