The present bail application has been moved by the applicant-accused Hasan Ali for the offence punishable under Sections 8/20/60 of N.D.P.S. Act, 1985 in Case Crime No.151 of 2024, Police Station- Chopan, District- Sonbhadra. 3. Sri Krishna Nand Singh, learned counsel appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case. The accused is a truck driver from where the police has shown recovery of 364.4 kg. Ganja. The charge sheet has been submitted against the applicant. There is no independent witness of arrest and recovery. The mandatory provision of Section 50 N.D.P.S. Act has not been complied. The applicant is languishing in jail since 03.08.2024.
