This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Asif seeking enlargement on bail in Case Crime No. 217 of 2024, under Sections 191 (2), 191 (3), 190, 109, 115 (2), 352, 351 (2), 324, 74, 3 (5), 331 (5), 103 (2), 331 (6), 61 (2) BNS, Police Station- Shahi, District- Bareilly. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 20.07.2024. It is submitted that similarly placed co-accused, Bakhtawar, Israf @ Asraf and Asid and Rashid have already been enlarged on bail of by coordinate Bench of this Court by order dated 22.05.2025 and 15.04.
