This bail application has been moved on behalf of accused- applicant, Neeraj Gupta seeking enlargement on bail in Case Crime No.11 of 2024, under Section 8/20/29 N.D.P.S. Act, Police Station Gandhi Park, District Aligarh. 3. Learned counsel for the applicant submits that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 05.05.2024. From the perusal of the First Information Report, it appears that 3 kg of Charas has been recovered from the possession of the co- accused Neeraj. He further submits that mandatory provision of Section 50 of N.D.P.S Act has not been complied with.
