This bail application has been moved on behalf of accused- applicant, Neeraj Gupta seeking enlargement on bail in Case Crime No.11 of 2024, under Section 8/20/29 N.D.P.S. Act, Police Station Gandhi Park, District Aligarh. 3. Learned counsel for the applicant argued that the accused- applicant is innocent he has been falsely implicated in this case. From the perusal of the First Information Report, applicant-Neeraj is named in the FIR as per the recovery memo and he arrested on the spot by N.C.B. and 3 kg of Charas has been recovered from the possession of the accused-applicant Neeraj. He further submits that recovery memo was prepared on the spot, but it was prepared in the Police Station Gandhi Park, District Aligarh. The accused is in judicial custody since 05.05.2024.
