Chief Judicial Magistrate, Fatehpur vide letter dated 07.08.2024 has informed this Court that sole appellant Kailash has already passed away on 24.07.2020. 3. In verification of his death, statement of Ram Devi, wife of the deceased has been recorded. Death certificate issued by Government of Uttar Pradesh has been annexed. Police report of S.I. Sandeep Kumar Tiwari of Police Station Chandpur, District Fatehpur has also been annexed. 4. Learned AGA could not dispute the aforesaid facts. 5. In view of the above, since the sole appellant has already passed away, the instant criminal appeal is dismissed as having been abated.
