Chief Judicial Magistrate, Jalaun at Orai vide letter dated 27.01.2025 has informed this Court that sole appellant Ballan has already passed away on 29.01.2012. 3. In verification of his death, statement of Aslam, son of Kallu, nephew of the deceased has been recorded. Death certificate issued by Government of Uttar Pradesh has been annexed. Statement of S.I. Puttu Lal of Police Station Kalpi, District Jalaun has also been annexed. 4. Learned AGA could not dispute the aforesaid facts. 5. In view of the above, since the sole appellant has already passed away, the instant criminal appeal is dismissed as having been abated. 6. Trial court record be remitted back to the court concerned.
