In verification of his death, statement of Kapil Kumar brother in-law of the deceased and Rishipal brother of the deceased has been recorded. Police report by S.I. Mohd Tariq, Police Station-Chhajlait, District-Moradabad has also been annexed. 2. In view of the above since sole appellant had already passed away, this criminal appeal stands dismissed as having been abated. 3. Trial court record, if any, be remitted back to the court concerned.
