The present criminal appeal arises from the judgment and order dated 8.1.2015 passed by Sri Chandrapal Singh, learned Additional Sessions Judge/Special Judge (E.C. Act.) Budaun in Sessions Trial No. 1263 of 2008 (State vs. Sarvesh), under Section 302/34, 307/34 IPC arising from Case Crime No. 284 of 2008 P.S. Usawan, District Badaun and Sessions Trial No. 1264 of 2008 (State vs. Sarvesh), under Section 25 of Arms Act, arising from Case Crime No. 287 of 2008, P.S. Usawan, District Budaun. By that order, the learned trial court has convicted the appellant for offence under Section 302 IPC and sentenced him for life together with fine Rs. 20,000/- with default sentence six months.
