Heard learned counsel for the appellant, learned AGA for the State and perused the record. 2. Chief Judicial Magistrate, Mirzapur vide letter dated 11.01.2022 has informed this Court that sole appellant Lala Kole has already passed away in March, 2022. 3. In verification of his death, statement of Radhey Shyam, son of the deceased and Ram Babu, neighbour of the deceased has been recorded. Death certificate issued by Gram Pradhan Ram Naresh, Gram Panchayat Kothi (Madwa Nevada), Block Lalganj, District Mirzapur has been annexed. Police report of S.I. Indu Bhushan of Police Station Lalganj, District Mirzapur has also been annexed. 4. Learned AGA could not dispute the aforesaid facts. 5.
