Present criminal appeal has been presented against the judgment and order dated 15.10.2022 passed by Special Judge (SC/ST) (POA) Act, Sonbhadra in Special Sessions Trial No. 05 of 2006 (State of U.P. Vs. Raj Kumar @ Auwa and another), arising out of the Case Crime No. 1001 of 2005, under Sections 302, 201 IPC and Section 3(2)(V) SC/ST Act, Police Station Chopan, District Sonbhadra. 3. Brief matrix of the case is that the informant Smt. Basanti Devi lodged first information report to the effect that on 11.10.2005 at about 8 p.m. appellants Raj Kumar @ Auwa and Raj Kumar @ Gundawa came to her house and took away her husband Santu Gaur in their company for viewing the Ram Leela.
