No one has appeared on behalf of the appellant to press this appeal, however, learned AGA for the State is present. 2. Chief Judicial Magistrate, Ghaziabad vide letter dated 04.05.2022 has informed this Court that sole appellant Kamarul Hasan has already passed away on 06.09.2009. 3. In verification of his death, statement of Rashid Hasan and Khalida, son and daughter respectively of the appellant- deceased Kamarul Hasan, has been recorded. Death certificate issued by Gram Pradhan Asif Mazahir, Gram Panchayat Azampur, Block Dhaulana, District Hapur has been annexed. Police report of S.I. Manvir Singh of Police Station Pilkhuwa, District Hapur has also been annexed. 4. Learned AGA could not dispute the aforesaid facts. 5. In view of the above, since the sole appellant Kamarul Hasan has already passed away, the instant criminal appeal is dismissed as having been abated. 6. Trial
