The instant Criminal Appeal under Section 374(2) of Criminal Procedure Code (hereinafter referred as Cr.P.C.) has been filed against the judgment and order dated 12.02.2013 passed in Session Trial No.561/2009; State of U.P. versus Dharmeshwar and others by the Additional District and Session Judge (Ex-cader) Court No.2, Sitapur arising out of Case Crime No.159/2006, under Section 307 of Indian Penal Code (hereinafter referred as I.P.C.), Police Station Misrikh, District Sitapur, by means of which the appellants Dharmeshwar and Babu Ram have been convicted under Section 307 I.P.C. and sentenced to rigourous imprisonment of four years with fine of Rs.2000/- each and in default of payment
