Present appeal arises from the judgement and order dated 30.07.1985 passed by Shri K.G. Rastogi, learned Sessions Judge, Budaun, in Sessions Trial No. 327 of 1983 (State vs Ram Prasad, Ram Bilas, Mahesh and Suresh). By that judgement and order, learned court below has convicted the appellants Ram Bilas and Mahesh for offence under Section 302 I.P.C. read with Section 34 I.P.C and awarded life imprisonment. The accused Ram Bilas has also been convicted for the offence under Section 323 I.P.C. and awarded rigorous imprisonment for six months.
