No one has appeared on behalf of the appellant to press this appeal, however, learned AGA for the State is present. 2. Chief Judicial Magistrate, Farrukhabad vide letter dated 12.12.2019 has informed this Court that sole appellant Awdhesh Singh has already passed away. 3. In verification of his death, statement of Gram Pradhan Vinod Kumar of Gram Panchayat Majhola, Block Kayamganj, District Farrukhabad has been annexed. Statement of S.I. Rahish Khan of Police Station Kayamganj, District Farrukhabad has also been annexed, wherein it has been clearly stated that about one year back, sole appellant Awdhesh Singh has already passed away. 4. Learned AGA could not dispute the aforesaid facts. 5. In view of the above, since the sole appellant has already passed away, the instant criminal appeal is dismissed as having been abated. 6. Trial court record be remitted back to the court concerned. Order
