Chief Judicial Magistrate, Ghazipur vide his letter dated 29.04.2023 has informed this Court that the sole appellant-Manoj Kumar Dubey has already passed away about 21 years back. 3. In verification of his death, statement of Shri Shanker Bahadur Dwivedi, brother of appellant-Manoj Kumar Dubey has been recorded. Death certificate duly issued by Gram Pradhan-Geeta Devi has also been annexed. Police Report by Head Constable Harischandra, Police Station Bhawarkol, District Ghazipur has also been annexed. 4. In view of the above, since the sole appellant has already expired, this Criminal Appeal is dismissed as having been abated. 5. Trial court record be remitted back to the court concerned.
