The submission of learned counsel for the review-petitioner is that this Court failed to consider the entitlement of the review- petitioner for Financial Up-gradation Scheme from the date of entitlement i.e. 28.03.2009, which as per the review-petitioner has been wrongfully given to him in the same grade-pay. 3. It is also submitted that the Court failed to consider the Office Memorandum dated 16.12.2011 which clearly provided for entitlement of the 3rd ACP under Clause 13(B) of the said Office Memorandum. 4.
