Learned counsel for respondent/plaintiff appears on advance notice. 2. A very short point is involved here. 3. The case is otherwise at the stage of final arguments but the defendant was having reservation with respect to his own signatures, allegedly, appearing on the invoice in question. In the written statement also, he has denied having signed any such invoice. 4. The original invoice had been filed by the plaintiff in the complaint filed by him under Section 138 Negotiable Instruments Act, 1981 in which the defendant was the sole accused. 5. Earlier, the defendant had sought opinion of handwriting expert based on “photocopy of the invoice” and such handwriting expert i.e. Dr. A K Gupta, entered into witness box as DW-4.
