At the very outset learned counsel for the petitioner submits that the petitioner is confining this petition to the relief clause no. (B) of the petition which is as under: "B) To issue a writ, order or direction in the nature of Mandamus commanding the respondent no. 2 to decide the departmental appeal Dated 22.10.2022 submitted by the Petitioner." Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 2 to consider and decide the pending departmental appeal strictly in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 2 shall consider and decide the departmental appeal dated 22.10.2022 within a period of two months from the date of receipt of certified copy of this order.
