Heard Sri Ulajhan Singh Bind, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner seeks direction in the nature of mandamus to command respondents to consider the claim of the petitioner for regularization. It is contended by Sri Bind that petitioner is entitled for regularization under the U.P. Daily Wages Group - D Post (Appointment and Regularization) Rules, 2001. Learned Standing Counsel on the contrary submits that petitioner has himself admitted to be working with the respondent establishment since 2008 and hence he does not fall within the cut off provided under the Rules, 2001. Upon a pointed query being made, learned counsel for the petitioner could not dispute that petitioner has been working as a daily wage employee only since 2008.
