By means of this petition filed under Article 226 of the Constitution petitioner claims reinstatement as Home Guard volunteer on account of judgment/ acquittal dated 09.11.2023 passed by the law court in Special Case No. 01 of 2008 arising out of Case Crime No. 08 of 2006 under Sections 354/323 IPC and Section 3(1) 10 Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. 3. It is argued on behalf of petitioner that earlier order was passed on 18.09.2008 depriving him form duty only on account of pending criminal case and the said order was reiterated vide order dated 07.09.2009. 4.
