Heard learned counsel for the petitioner as well as learned Standing Counsel. A preliminary objection has been raised by learned Counsel for the respondent Mr. Bal Mukund that since the Railways has already stood notified under Section 14 of the Central Administrative Tribunal Act, petitioner should approach the Tribunal at the first instance. Learned counsel for the petitioner though does not dispute the same but submitted that petitioner being a widow lady and suffering from starvation matter can be considered and disposed of. In the considered view of the Court, in view of the Constitution Bench judgment of Supreme Court in the case of L. Chandra Kumar v. Union of India, (1997) 3 SCC 261 once the department is notified under the Central Administrative Tribunal Act, the power of judicial review should be exercised only after the order is passed by the Tribunal in the original application.
